Regulations on the measures, manner and procedures regarding the protection and safety of students during curricular and other activities organised by Savremena International School

Pursuant to Article 57, Paragraph 1 and in conjunction with Articles 41 and 42 of the Law on the Foundations of the Education System (Official Gazette of the Republic of Serbia, no. 72/09, 52/11, 55/13, 35/15 – authentic interpretation, 68/15 и 62/16 – decision of the Constitutional Court) and Article 59 of the Statute of Savremena International School, at the meeting held on 14 September 2017, the school board of Savremena International School adopted

REGULATIONS ON THE MEASURES, MANNER AND PROCEDURES REGARDING THE PROTECTION AND SAFETY OF STUDENTS DURING CURRICULAR AND OTHER ACTIVITIES ORGANISED BY SAVREMENA INTERNATIONAL SCHOOL

I Basic provisions

Article 1

The Regulations on the measures, manner and procedures for the protection and safety of students prescribes the measures, manner and procedures for the protection and safety of students of Savremena International School in Belgrade (hereinafter: School) during their stay at the school and during all activities organised by the School, the manner of their implementation and the liability of students and teachers for failure to comply with the provisions of these Regulations.

Student protection and safety is provided in accordance with specific requirements, forms, measures, methods, procedures and guidelines on the protection and safety of students issued by the Minister of Education.

Article 2

These Regulations serve to ensure the students’ right to protection and safety:

  • In the school building and on the school grounds;
  • Outside the school building and school grounds – during educational or other curricular or extracurricular activities organised by the School.

Article 3

Students have the right to protection and safety from:

  • Actions taken by other people,
  • Illness and injuries,
  • Danger and harm in the course of their education at the School,
  • Fire, floods, natural disasters and other natural phenomena that may endanger their safety.

Article 4

In their daily contact with the students, and especially during homeroom sessions, class teachers and subjects teachers are obligated to familiarise the students with the dangers they may face during their stay at school and while performing other activities organised by the School, as well as the ways in which those dangers may be avoided or eliminated.

Article 5

All employees of the School, the students, parents or legal guardians of the students (hereinafter: parents) and third parties who enter and spend time in the school building, school grounds or other places where instruction or other activities organised by the School occur, are obligated to comply with the provisions of these Regulations.

Article 6

Failure to comply with the measures, methods and procedures for the protection and safety prescribed in these Regulations shall be considered a serious violation of the work regulations and shall institute disciplinary proceedings in accordance with the Law.

Disciplinary liability of the employees does not exclude accountability under criminal and substantive law.

Deliberate failure to comply with the safety rules and measures prescribed by these Regulations by students shall be considered a serious violation of student obligations, which institutes a disciplinary procedure in accordance with the Law.

Article 7

Employees, parents and students are obligated to report any occurrence which in their view could represent a potential danger to student safety to the Principal, School Secretary, counsellor, teacher on monitoring duty or other authorised person.

Article 8

It is a special obligation of the Principal to occasionally, without prior notice, and at least once a month, check if the measures for the protection and safety of students are being implemented. The failure to implement measures for the protection and safety of students prescribed in these Regulations is a reason for fair dismissal of the principal under the Law.

Article 9

The School is obliged to cooperate with state bodies, municipal bodies and other entities and competent authorities if such cooperation is needed to ensure and implement the measures prescribed in these Regulations.

Article 10

Provisions of other general acts of the School the application of which is relevant for the implementation of the protection and safety of students shall apply accordingly to these Regulations and provisions defined in it.

II Protection and safety in the school building and on the school grounds

Article 11

During lessons and other activities, the front door shall be unlocked at all times.

School security is authorised to unlock the front door.

Security personnel shall unlock the student entrance half an hour before the lessons start, check the school premises and notify the Principal or the School Secretary if any necessary measures are to be taken.

Article 12

When there are no lessons or any other activity in the School building, all entrance doors shall be locked.

School security is in charge of unlocking the entrance doors before working hours and locking them after working hours, and in their absence – another person authorised by the Principal.

Article 13

Student behaviour before, during and after lessons and other school activities, entry and exit from school, monitoring duties, relationships with other students and employees, as well as other rights, obligations and responsibilities of students referring to their behaviour are defined by the School Code of Conduct.

Responsibilities of teachers on monitoring duty before lessons, during breaks and after lessons, as well as during students’ stay at school are defined by the School Code of Conduct.

Responsibilities of class teachers, teachers and all employees, as well as parents during their stay at school, reception and movement of persons who enter the school building, the smoking ban, as well as the prohibition of carrying explosive materials and other dangerous objects are defined by the School Code of Conduct.

PROTECTION FROM ILLNESS AND INJURIES

Article 14

To ensure the protection and safety of students from illness and infection, the School:

  • 1. Shall make sure that the school premises and grounds are clean and tidy in accordance with the sanitary and hygienic measures and regulations;
  • 2. Shall organise prescribed periodic health examinations for students;
  • 3. Shall act in accordance with the measures of competent authorities and health regulations;
  • 4. Shall inform the parents in the event of observing any health changes in a student, undertake emergency measures if necessary, or provide first aid to the student without delay, and inform the competent healthcare institution if need be;
  • 5. Shall inform the parents of the student whose health condition was deemed potentially dangerous for other students and employees according to the assessment of the Principal, Assistant Principal, teacher or expert associate;
  • 6. Shall perform unannounced testing of students to detect the presence of narcotics and/or psychoactive substances in the organism on school premises throughout the year, in cooperation with a healthcare institution specialising in addiction treatment with which the School signed a contract and in the presence of health professionals from the aforementioned healthcare institution;
  • 7. Shall perform unannounced testing of students to detect the presence of alcohol in the organism throughout the school year and in cooperation with a competent healthcare institution/laboratory.

Article 15

To ensure the protection and safety of students from injury, the School:

  • 1. Shall procure and ensure the use of school furniture, teaching aids and other objects which have been deemed safe to use and correspond to psycho-physical needs of students;
  • 2. Shall apply the standards and norms pertaining to the school premises, number of students per class and other requirements for performing its activity;
  • 3. Shall provide continuous supervision of students by a teacher or an expert associate while using devices or objects which may cause injuries, as well as during activities which may cause potential injuries.

Article 16

Parents are obligated to take their child whose health condition is such as to represent a potential danger to other students and employees to an appropriate health examination and not send him/her to school or other activities organised by the School until he/she receives a doctor’s clearance.

Protection from fire, floods, electric shock, lightning strikes and other dangerous phenomena

Article 17

To protect themselves from fire, employees and students are obligated to comply with the measures defined under the Law on Fire Protection, other regulations managing this issue, fire protection plans, decisions of the competent local government body, as well as the general act of the School regulating the manner, procedures and measures in the field of fire protection and prevention.

Article 18

To ensure protection and safety from flood and/or sewer overflow, a licensed professional hired by the School will check the integrity of water and sewer pipes and undertake the necessary measures in case of observed changes that may endanger the safety of students and employees of the School.

All employees and students are obligated to inform the Principal or School Secretary without delay about any observed changes in the water supply and sewer system which may endanger the safety of students and employees of the School.

Article 19

To ensure protection and safety from electric shock, a licensed professional hired by the School will check the integrity of electrical wiring and undertake the necessary measures in case of observed changes that may endanger the safety of students and employees of the school.

All employees and students are obligated to inform the Principal or School Secretary without delay about any observed changes on the electrical installations which may endanger the safety of students and employees of the School.

Article 20

Devices, other objects or substances used in teaching, for maintaining hygiene or for other purposes must be kept out of reach of unauthorised persons if they are potentially dangerous for the life and health of the students.

Article 21

To ensure protection and safety from lightning strikes, a licensed professional hired by the School will check the integrity of lightning protection system in accordance with the regulations.

All employees and students are obligated to inform the Principal, Assistant Principal or the School Secretary without delay about any observed changes in the lightning protection system which may endanger the safety of students and employees of the School.

Article 22

Protection from other dangerous objects and phenomena shall be exercised pursuant to Articles 18 through 22 of these Regulations.

III Protection and safety on the way to and from school

Article 23

The School is not responsible nor can be held accountable for the protection of student health and safety on the way from home to school and vice versa, nor for their safety on the way from home to locations where certain teaching activities are to be held in cases when the School does not organise student transport.

In cases referred to in Paragraph 1, responsibility for student health and safety falls to the parents.

The School, i.e. teaching staff, are obliged to undertake all the necessary measures for the protection of student health and safety when instruction is organised on the premises of other institutions in cooperation with the employees of the said institutions.

Article 24

The School shall launch initiatives related to improving traffic safety in the vicinity of the School (installing speed bumps, traffic lights and other devices, organising school crossing supervision by traffic officers, etc.) and submit them to the competent authorities.

Article 25

Protection of students in traffic is realised through organising lectures held by traffic experts, screening films about traffic and through discussions in homeroom classes and parent-teacher meetings.

IV Safety and protection outside school premises, during curricular and other activities organised by the school

Article 26

Protection and safety of students while on school trips, as well as while attending other activities outside the school building and the school grounds are regulated by the basic provisions of these Regulations, and the provisions about the protection and safety of students while in the school building and on the school grounds apply accordingly.

Safety and protection of students on school/study trips

Article 27

School/study trips as a form of instruction are carried out in accordance with the School’s annual activity plan and school/study trip programme.

School/study trips can be organised only after securing the consent of the School’s parent council.

Article 28

When selecting the best offer for organising school/study trips, the School shall pay special attention to the bidder’s ability to ensure safety and protection of students during the organised activity.

The agreement signed for the organisation of a school/study trip between the School and the best bidder shall contain specific provisions referring to protection and safety of students.

The bidder’s ability to ensure the protection and safety of students shall particularly relate to:

  • 1. Possessing the required work licence;
  • 2. Ability to organise student school/study trips in terms of personnel, technology and equipment;
  • 3. Ability to ensure the protection and safety of students in the objects where they are located (physical and technical security, medical aid, etc.) in terms of personnel and equipment;
  • 4. Quality meals for students;
  • 5. Quality and technical fitness of buses for transporting students. Student accommodation on class/study trips must solely include objects which meet the requirements specified for these educational activities.

Responsibilities of the School with regard to the protection from discrimination, abuse, neglect, political participation and actions

Article 29

This form of student safety and protection is achieved through compliance with the School Code of Conduct and activities of the school expert team for protection against discrimination, violence, neglect and abuse.

Article 30

The School prohibits activities that aim to endanger, ridicule, discriminate or set apart students, employees or any other person or persons based on their: race, nationality, ethnicity, language, religion or gender, physical or psychological traits, developmental disorder or disability, health status, age, social or cultural background, financial status, political affiliation, as well as encouragement or failure to prevent such activities. All forms of discrimination are also regulated by the competent Law on the Prohibition of Discrimination.

Discrimination of a person or persons implies any direct or indirect, open or covert exclusion or restriction of one’s rights and freedoms, unequal treatment or failure to act, as well as unjust discrimination through favouritism or partiality.

Special measures introduced to ensure full equality, protection and promotion of persons, or groups of persons who are in an unequal position are not considered as acts of discrimination.

The School is obligated to act in accordance with the document which defines specific criteria for recognising forms of discrimination by employees, students or third parties, jointly issued by the Minister of Education and minister in charge of human rights.

Article 31

The Law and general acts of the School prohibit: physical, psychological and social violence; abuse and neglect of students; corporal punishment and personal insults, as well as sexual harassment and abuse of students or employees.

The School prohibits any form of violence and abuse of students, teachers, expert associates or other employees by a student, student’s parent or third party.

The violation of this prohibition shall compel the School to initiate offence or criminal proceedings against the student, student’s parent or third party.

Article 32

The School prohibits all forms of political activism or organisation, as well as using the school premises for this purpose.

V Final provisions

Article 33

Any proposed modifications to these Regulations shall undergo the procedure stipulating the adoption of said Regulations.

Article 34

The Regulations come into force on the eighth day from its publishing on the School noticeboard.

Article 35

Once these Regulations have come into force, the Regulations on the measures, manner and procedures for the protection and safety of students at Savremena International School No. 16/2015, Belgrade, 29 January 2015 shall cease to apply.
